Delaware Counsel for Bochner, Touhey Myer leverages his extensive litigation experience, technical background, and unique analytical perspective to develop creative solutions to his client’s legal problems.

Touhey focuses his practice on litigating complex corporate and technical matters before the District of Delaware and the Delaware Court of Chancery. A licensed Patent Attorney, Touhey also practices before the USPTO prosecuting a wide variety of patent and trademark matters.

Touhey has deep experience with the Delaware Bar, as well as New Jersey and Pennsylvania state and federal courts. He maintains a robust copyright infringement defense practice, using knowledge acquired from enforcing prior campaigns to assist his clients in quickly resolving infringement claims. Outside of his intellectual property practice, Touhey also practices American Beverage Law and serves as outside general counsel for many of his corporate clients, specifically in the Pharmaceutical and Wine and Spirits spaces.

Touhey also serves as Managing Partner of the Delaware Office of Kratz & Barry, LLP, where he and his partners focus their practice on Hatch-Waxman litigation in the Delaware and New Jersey federal court.

An active member of the local intellectual property community, Touhey serves on the Board of the Philadelphia Intellectual Property Law Association (PIPLA) as its past President (2021).

  • Served as lead and local counsel on numerous Hatch-Waxman litigation matters before the District of Delaware, obtaining favorable rulings and settlements on behalf of clients.
  • Served as Delaware Counsel for Ryanair DAC in Federal District Court litigation against Booking.com which resulted in first-of-its-kind CFAA jury verdict in favor of Ryanair DAC.   • Evaluated contingent fee patent litigation matters by collaborating with litigation funding groups to determine best targets, the likelihood of success, and potential damages awards.
  • Successfully terminated a wine franchise agreement by establishing “good cause” before the Virginia Alcoholic Beverage Control Authority.
  • Reached favorable settlements for numerous clients accused of copyright infringement.
