The National Labor Relations Board’s Acting General Counsel has rescinded Biden-era enforcement guidance, signalling a shift toward more employer-friendly policies. The rescinded guidance previously sought to expand the NLRB’s reach beyond unionization, impacting severance agreements, non-competes, and electronic surveillance.
