Bochner PLLC Secures Major Second Amendment Victory in Federal Court

Bochner PLLC is proud to announce a significant constitutional law victory on behalf of three tenants of the Cortland Housing Authority and the Second Amendment Foundation. In the case Hunter et al. v. Cortland Housing Authority, 5:23-cv-01540 (N.D.N.Y.), the U.S. District Court for the Northern District of New York has issued a permanent injunction overturning the Housing Authority’s longstanding ban on the possession of firearms in government-funded housing.

The ruling, issued by Judge Glenn T. Suddaby, affirms that tenants have the right to lawfully own and possess firearms in their residences, to engage in lawful self-defense and defense of others in common areas, and to transport firearms to and from their homes. The injunction further requires that all future lease agreements comply with the Second Amendment “in all respects” and prohibits the Housing Authority from censoring speech on social media platforms.

The Court also awarded attorneys’ fees to the plaintiffs. Bochner PLLC’s Constitutional Law Group, led by Edward Paltzik and supported by Serge Krimnus and Meredith Lloyd, represented the plaintiffs in this landmark case.
