Bochner PLLC Defeats Summary Judgment in $1M Foreclosure Case

Bochner PLLC attorneys Jeremy Doberman and Isaac Diskind successfully defeated a motion for summary judgment in a commercial foreclosure case in Westchester County Supreme Court.

They argued that the plaintiff had fraudulently induced the defendant into buying the property by misrepresenting the seller's knowledge regarding environmental issues which hindered development. Despite claims that the defendant failed to make loan payments, the Court found triable regarding the seller’s alleged failure to disclose these violations that impacted the property's development.

Justice Gretchen Walsh agreed with Doberman's and Diskind's arguments, allowing the case to proceed to discovery. Bochner looks forward to continuing its defense through trial and on appeal, if necessary.
